Terms & Conditions
These Terms explain the rules that apply when you purchase, activate, access, contribute to, or manage a Memorion memorial or related service.
About Memorion
Memorion provides digital memorial services that allow users to create, access, preserve, and share memorial content.
The current Memorion Digital service may include memorial hosting, Workspace access, storage, Family collaboration, visitor contributions, a personal QR code, and optional upgrades or access extensions where available.
Physical Memorion plaques are not part of the current V1 digital launch offer and may be offered separately if and when available.
Acceptance of Terms
By placing an order, activating a Memorion product, creating an account, accepting a Family invitation, submitting content, or otherwise using the service, you agree to these Terms to the extent applicable to your use of Memorion.
If you do not agree with these Terms, you should not use the relevant service.
Orders and activation
A purchase may relate to a physical QR plaque, digital QR product, memorial access, storage, access extension, or another product or service described at checkout.
Product details, price, included storage, access period, delivery method, and any applicable upgrade terms shown at the time of purchase form part of the purchase conditions.
A QR code or activation identifier may be assigned to a specific memorial or activation flow.
Memorial Owner
The person who creates or activates a memorial under their account is treated as the Memorial Owner unless Memorion records otherwise.
The Memorial Owner is responsible for managing the memorial; choosing what content is published; managing Family access; managing settings and visibility; managing available storage or access extensions; ensuring that content they publish or approve is lawful and appropriate; and protecting account credentials.
Family members
The Memorial Owner may invite trusted Family members.
Family access is personal to the invited account and may not be transferred.
Family members may help review contributions and manage supported memorial content within the permissions provided by the service.
Family members do not receive ownership rights, billing control, invitation control, storage or plan control, or permanent-delete rights unless the service explicitly grants such permissions.
The Memorial Owner may revoke Family access at any time.
Removing Family access does not automatically delete previous contributions made by that Family member.
Visitors and contributions
Where enabled, visitors may submit memories, photographs, thoughts, replies, or other contributions.
Submission does not guarantee publication.
Submitted content may be reviewed, rejected, approved, edited where permitted, or removed by authorised memorial managers or administrators.
A contributor remains responsible for the content they submit and must have the right to share it.
Content rights
You retain ownership of original content that you create and submit to Memorion.
By uploading or submitting content, you grant Memorion a non-exclusive licence to host, store, reproduce, display, resize, technically process, transmit, back up, and otherwise use that content only as reasonably necessary to operate, provide, maintain, and display the Memorion service.
Where content is submitted for publication on a memorial, you also authorise the relevant Memorial Owner and authorised memorial managers to manage that content within the features provided by Memorion.
You must not upload content that infringes copyright, privacy, confidentiality, personality, or other rights of another person.
Prohibited content and misuse
Users must not use Memorion to upload unlawful or infringing content; impersonate another person; deliberately publish private or confidential information without appropriate authority; harass, threaten, exploit, or abuse another person; distribute malware, spam, or malicious code; attempt unauthorised access to another account or memorial; interfere with the security or operation of the service; or use the service for fraudulent or unlawful purposes.
Moderation
Memorion may remove or restrict content or access where reasonably necessary to enforce these Terms, protect users, comply with law, respond to valid rights claims, address security issues, or prevent misuse.
Memorion is not required to pre-review every item of user-submitted content.
Memorial access period and storage
The memorial's included access period and storage allowance are those shown for the relevant product or plan at the time of purchase or within the owner Workspace.
Where available, additional storage or access extensions may be purchased separately.
If an access period approaches expiry, Memorion may offer an extension or renewal option.
The exact entitlement shown for the memorial account or purchase record takes priority over general marketing descriptions.
Physical QR products
Physical products may vary slightly in appearance due to materials, manufacturing processes, display differences, or reasonable production tolerances.
The customer is responsible for providing correct personalisation, delivery, and order information.
Where a product is made to the customer's specifications or clearly personalised, cancellation or withdrawal rights may be limited as described in the Refund Policy and applicable law.
Digital products and services
Digital QR products, memorial access, storage upgrades, and access extensions may be supplied electronically or activated shortly after purchase.
Where the customer asks for digital content or a service to begin during a statutory withdrawal period, applicable consumer law may affect the right to withdraw once performance has begun or been fully completed.
Where required by applicable law, Memorion will request the customer's express consent or acknowledgement before immediate supply or performance begins.
Payments
Prices and applicable taxes are shown during checkout.
Payment processing may be provided by third-party payment providers.
An order may not be considered confirmed until payment has been successfully authorised or otherwise accepted.
Service availability
Memorion aims to keep memorials and account services available reliably, but continuous uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur due to maintenance, security updates, hosting issues, network problems, third-party services, or circumstances outside reasonable control.
Changes to the service
Memorion may update or improve features, security, technical infrastructure, and user interfaces over time.
We will not intentionally remove a purchased core entitlement without a lawful basis or appropriate replacement, but individual features and interfaces may evolve as the service develops.
Account security
Users are responsible for keeping account passwords confidential and for activity carried out through their account unless caused by Memorion's own security failure or otherwise provided by law.
If you believe an account has been compromised, contact info@memorion.eu.
Suspension or termination
Access may be restricted or suspended where reasonably necessary due to serious misuse, security risks, fraudulent activity, unlawful content, breach of these Terms, or legal requirements.
Where practical and appropriate, the user will be given information about the reason and an opportunity to resolve the issue.
Consumer rights
Nothing in these Terms excludes or limits mandatory consumer rights that cannot legally be excluded.
Consumers may have statutory rights relating to withdrawal, defective goods, digital services, remedies, and refunds.
See the Refund Policy for additional information.
Liability
Memorion is responsible for providing the service with reasonable care and in accordance with applicable law.
To the extent permitted by law, Memorion is not responsible for losses caused by circumstances outside its reasonable control, misuse of the service, inaccurate information supplied by users, or third-party services outside Memorion's control.
Nothing in these Terms limits liability where such limitation is prohibited by law.
Privacy
Personal data is handled in accordance with the Memorion Privacy Policy.
Changes to Terms
These Terms may be updated when the service, products, legal requirements, or operating model changes.
Material changes affecting existing users or purchased services should be communicated where required by law or reasonably necessary.
